Cardholder Agreement

1. Introduction and Parties
This Cardholder Agreement ("Agreement") governs your use of a virtual payment card ("Virtual Card") issued in connection with the Mosey Platform. Please read this Agreement carefully before activating or using a Virtual Card.
Card Issuer: Your Virtual Card is issued by Transact Payments Malta Limited ("Card Issuer"), a company licensed by the Malta Financial Services Authority as an Electronic Money Institution (licence number C91879), authorised to issue electronic money and provide payment services within the European Economic Area. The Card Issuer's registered address is Vault 14, Level 2, Valletta Waterfront, FRN 1914, Floriana, Malta.
Programme Manager: Stripe Payments Europe, Limited ("Stripe"), a company incorporated in Ireland, acts as the programme manager for Virtual Card issuance and processing on behalf of the Card Issuer.
Platform Operator: Mosey Limited ("Mosey"), 77 Camden Street Lower, Dublin 2, D02 XE80, Ireland, operates the Mosey Platform through which the Virtual Card feature is offered. Mosey is not a payment institution, electronic money institution, or card issuer.
You / Cardholder: The individual Mosey user to whom a Virtual Card is issued.
2. About the Virtual Card
2.1. Your Virtual Card is a virtual Visa prepaid card denominated in EUR. It exists only in digital form within the Mosey app and does not have a physical counterpart.
2.2. The Virtual Card is electronic money ("e-money") issued by the Card Issuer. It is not a credit card, debit card, or bank account. Funds loaded onto the Virtual Card are electronic money within the meaning of the Electronic Money Directive (2009/110/EC) and the European Communities (Electronic Money) Regulations 2011.
2.3. The Virtual Card is linked to your Mosey Account and the Loyalty Programs of participating Businesses. It enables you to redeem accumulated Loyalty Credits as payment at qualifying Businesses.
3. Eligibility
To receive and use a Virtual Card, you must:
3.1. Be at least 18 years old.
3.2. Hold an active Mosey Account in good standing.
3.3. Have accumulated redeemable Loyalty Credits under a participating Business's Loyalty Program.
3.4. Provide any identity verification information reasonably requested by the Card Issuer, Stripe, or Mosey, as required by applicable anti-money laundering laws (including the Criminal Justice (Money Laundering and Terrorist Financing) Act 2010).
3.5. Accept this Agreement.
4. Authorised Use
4.1. Restricted Use. Your Virtual Card may only be used to make purchases at registered Mosey Businesses that participate in the Virtual Card scheme and have an active Loyalty Program linked to the card. The Virtual Card cannot be used at any other merchant, online store, or for any other purpose.
4.2. Prohibited Use. You may not use the Virtual Card for:

Cash withdrawals or cashback transactions.

Purchases at non-participating merchants.

Person-to-person transfers.

Any illegal activity.

Any transaction that violates the Mosey Terms and Conditions.
4.3. Transaction Authorisation. Each transaction is authorised in real time. If the transaction amount exceeds your available balance or violates any applicable limits, the transaction will be declined.
5. Funding and Balances
5.1. Just-in-Time Funding. The Virtual Card operates on a just-in-time funding model. Funds are not pre-loaded onto the card. When you initiate a transaction, the required amount is funded from your linked payment method (as registered in your Mosey Account) at the moment of the transaction.
5.2. Balance. Your available Virtual Card balance corresponds to the EUR value of your redeemable Loyalty Credits under the applicable Loyalty Program. You can view your current balance in the Mosey app.
5.3. No Interest. Virtual Card balances do not earn interest.
5.4. No Credit. The Virtual Card does not provide credit. You can only spend up to the available balance derived from your Loyalty Credits.
6. Spending Limits and Controls
6.1. Per-Transaction Limit. Individual transactions are limited to the value of available Loyalty Credits for the applicable Business's Loyalty Program, or such lower limit as may be set by the Business or Mosey.
6.2. Daily / Monthly Limits. Mosey and/or the Card Issuer may impose daily or monthly spending limits for security purposes. Current limits are displayed in the Mosey app.
6.3. Mosey Controls. Mosey implements merchant category restrictions to ensure the Virtual Card can only be used at participating Mosey Businesses. Transactions at non-qualifying merchants will be automatically declined.
7. Fees
7.1. There is no fee for the issuance of a Virtual Card.
7.2. There are no monthly maintenance fees for your Virtual Card.
7.3. The Card Issuer or Stripe may charge fees for specific services (such as chargebacks or currency conversion, if applicable). Any such fees will be disclosed to you before they are incurred.
7.4. Mosey does not charge Cardholders any fees in connection with Virtual Card usage. Commission structures between Mosey and participating Businesses are governed by separate Business agreements.
8. Liability for Transactions
8.1. Authorised Transactions. You are responsible for all transactions you authorise using your Virtual Card.
8.2. Unauthorised Transactions. Under PSD2 (Payment Services Directive 2015/2366/EU) and the European Union (Payment Services) Regulations 2018:
(a) You must notify us immediately (and in any event within 13 months) if you become aware of any unauthorised or incorrectly executed transaction by contacting support@moseyfoodfinder.com.
(b) Where you have not acted fraudulently or with gross negligence, your maximum liability for unauthorised transactions is EUR 50, provided you have notified us without undue delay.
(c) You will not be liable for unauthorised transactions that occur after you have notified us of the loss, theft, or unauthorised use of your Virtual Card.
(d) You will not be liable for unauthorised transactions where Mosey or the Card Issuer has failed to provide a means for you to report the loss or misuse of the card.
8.3. Gross Negligence. If an unauthorised transaction results from your gross negligence (such as sharing your Mosey Account credentials), you may be liable for the full amount of the unauthorised transaction.
9. Disputes
9.1. If you believe a transaction on your Virtual Card is incorrect, unauthorised, or you have a dispute with a Business about a purchase, contact us at support@moseyfoodfinder.com within 30 days of the transaction.
9.2. We will investigate your dispute and provide a response within 15 business days. If we require additional time, we will notify you and provide a final response within 35 business days.
9.3. If your dispute is with a Business regarding the goods or services received, you should first attempt to resolve the matter directly with the Business. If the matter remains unresolved, contact us and we will assist in facilitating a resolution.
9.4. You may also contact the Card Issuer directly or file a complaint with the Malta Financial Services Authority (MFSA) or the Financial Services and Pensions Ombudsman (Ireland) if you are not satisfied with the outcome of a dispute.
10. Card Cancellation and Suspension
10.1. By You. You may cancel your Virtual Card at any time through the Mosey app (Settings > Payment > Virtual Card > Cancel) or by contacting support@moseyfoodfinder.com.
10.2. By Mosey or the Card Issuer. We or the Card Issuer may suspend or cancel your Virtual Card immediately if:

We suspect fraud, unauthorised use, or security concerns.

You breach this Agreement or the Mosey Terms and Conditions.

Your Mosey Account is suspended or terminated.

Required by law or regulatory order.

The Loyalty Program linked to your card is terminated by the Business.
10.3. Effect of Cancellation. Upon cancellation, any remaining balance (derived from unused Loyalty Credits) will be handled in accordance with the applicable Loyalty Program terms. You will not be charged a cancellation fee.
10.4. Account Deletion. If you delete your Mosey Account, your Virtual Card will be automatically cancelled and all associated Loyalty Credits will be forfeited as described in the Mosey Terms and Conditions.
11. Voucher Balance Integration
11.1. Where a Business's Loyalty Program includes voucher-based rewards, your Virtual Card balance may reflect both standard Loyalty Credits and any voucher balances associated with that Business.
11.2. Voucher balances loaded onto the Virtual Card are subject to the voucher terms set by the issuing Business (including any expiration dates) and the Mosey Terms and Conditions (Section 6, Vouchers and Tickets).
12. Data Protection
12.1. Your personal data in connection with the Virtual Card is processed by Mosey, Stripe, and the Card Issuer. Each party processes your data in accordance with their respective privacy policies:

Card Issuer (Transact Payments Malta Limited):
12.2. Data processed includes your name, Mosey Account information, transaction history, device information, and any identity verification information you provide.

13. Regulatory Disclosures
13.1. E-Money. The funds associated with your Virtual Card constitute electronic money issued by Transact Payments Malta Limited, authorised and regulated by the Malta Financial Services Authority.
13.2. PSD2. Your Virtual Card is a payment instrument within the meaning of the Payment Services Directive (2015/2366/EU). You are entitled to the consumer protections set out in PSD2 and its Irish transposition (European Union (Payment Services) Regulations 2018), including protections relating to unauthorised transactions, execution times, and information requirements.
13.3. Safeguarding. In accordance with the Electronic Money Directive, the Card Issuer safeguards funds received in exchange for electronic money by holding them in a segregated account with a credit institution or by obtaining an insurance policy or comparable guarantee.
13.4. Complaints. If you have a complaint about your Virtual Card:

First: Contact Mosey at support@moseyfoodfinder.com.

Second: If unresolved, contact Stripe at stripe.com/support.

Third: If still unresolved, you may refer your complaint to the Financial Services and Pensions Ombudsman (Ireland) at fspo.ie, or the Malta Financial Services Authority (MFSA) at mfsa.mt.
13.5. Compensation Schemes. Virtual Card balances are electronic money, not bank deposits, and are not covered by deposit guarantee schemes (such as the Irish Deposit Guarantee Scheme). However, your funds are safeguarded as described in Section 13.3.
14. Changes to This Agreement
14.1. We may update this Agreement from time to time. We will provide you with at least 60 days' notice of any material changes (as required by PSD2), via email or in-app notification.
14.2. If you do not agree with the changes, you may cancel your Virtual Card before the changes take effect.
14.3. Continued use of your Virtual Card after the changes take effect constitutes acceptance of the updated Agreement.
15. Governing Law
15.1. This Agreement is governed by the laws of Ireland. Any disputes arising under this Agreement shall be subject to the non-exclusive jurisdiction of the courts of Ireland, without prejudice to your rights as a consumer to bring proceedings in the courts of your country of residence.
